Appeals Court Frees Wind Farms From Raptor Dispute

Law360, New York (September 22, 2008, 12:00 AM EDT) -- An appeals court Thursday overruled a district court and allowed wildlife to be protected as a public trust, but upheld the dismissal of a suit against the Altamont Pass Wind Resource Area, holding that raptor safety lies with regulatory agencies and not with the power companies themselves.
