Bayer May Be Liable For Texas Superfund Site

Law360, New York (September 23, 2008, 12:00 AM EDT) -- A federal judge has ruled that Bayer AG's American unit may be liable for part of the cleanup of a contaminated former metal smelting facility in Texas, denying a motion by the company for summary judgment.

Judge Lee H. Rosenthal, of the U.S. District Court for the Southern District of Texas, ruled on Monday that a reasonable jury could find Bayer USA, the American arm of the international drug giant, liable for some of the cleanup at the site.
