Tying Case Against Amgen Voluntarily Dismissed

Law360 (September 24, 2008, 12:00 AM EDT) -- The Sheet Metal Workers National Health Fund has voluntarily withdrawn without prejudice an antitrust class action against biotech company Amgen Inc. alleging tying.

Monday's dismissal, in U.S. District Court for the District of New Jersey, stipulates that any subsequent complaint filed by the health fund arising from the same course of alleged conduct must be filed in the same district.

The health fund filed the proposed class action in November 2007, alleging Amgen was illegally tying and pricing the sales of three of its oncology products....
