NJ Couple Asks High Court For Help In $400M Tax Dispute

Law360, New York (September 28, 2015, 6:53 PM EDT) -- A New Jersey couple has asked the U.S. Supreme Court to review an unpublished Third Circuit decision upholding the dismissal of their suit challenging $400 million in taxes assessed by the Internal Revenue Service.

The Third Circuit violated their due process rights by finding new facts on appeal that are contradicted by the record, according to the certiorari petition filed Sept. 18 by Anna E. Charlton and Gary L. Francione. The dismissal by the courts also leaves the IRS free to disregard the decisions of the U.S. Tax Court, which found that the taxes were not due, the couple said....
