Neo@Ogilvy To Seek High Court Review In Whistleblower Case

Law360, New York (October 1, 2015, 8:56 PM EDT) -- Neo@Ogilvy LLC will appeal to the U.S. Supreme Court after the Second Circuit revived a workplace retaliation claim brought against the company by a whistleblower, according to a Wednesday filing asking the circuit court to keep the case open.

The appeals court in a 2-1 decision last month gave new life to a lawsuit brought by former Neo@Ogilvy finance director Daniel Berman. Berman was fired from the marketing firm after internally reporting suspected improprieties but before he blew the whistle to the U.S. Securities and Exchange Commission.
