Law360, New York (September 30, 2008, 12:00 AM EDT) -- A federal judge has handed a partial victory to Every Penny Counts Inc. in its patent lawsuit against Bank of America Corp. over the bank's Keep the Change program, sustaining some of EPC's objections to a claim construction recommendation by a magistrate judge in July.
EPC filed the suit last year, arguing that the banking giant's Keep the Change program infringes U.S. Patent Number 6,112,191, issued to EPC in 2000.
