High Court To Hear Shell, Railroads Superfund Appeal

Law360 (October 1, 2008, 12:00 AM EDT) -- The U.S. Supreme Court has agreed to hear an appeal from Shell Oil Co. and two railroads over a federal appeals court ruling that held them liable for cleanup costs at a Superfund site near Bakersfield, Calif.

The nation's highest court granted writ of certiorari on Wednesday to appeals from Shell, Union Pacific Railroad Co. and Burlington Northern and Sante Fe Railway Co. to review a March 2007 ruling holding them jointly and severally liable for contamination.
