Federal Circuit Gives Teva Go-Ahead For Generic Biaxin

Law360 (June 22, 2006, 12:00 AM EDT) -- The U.S. Court of Appeals for the Federal Circuit Thursday threw out a preliminary injunction barring Israeli drug maker Teva Pharmaceutical Industries Ltd. from selling a generic version of Abbott Laboratories’ extended-release antibiotic Biaxin.

Teva had appealed to the circuit court after a judge with the U.S. District Court for the Northern District of Illinois in Chicago granted Abbott’s request for a temporary injunction in June 2005.
