Broadcom Sues Qualcomm Over 'Exhausted' Patents

Law360, New York (October 8, 2008, 12:00 AM EDT) -- Semiconductor chipset maker Qualcomm Inc. has “over-asserted” its patent rights in a double-recovery scheme, driving down competition in the wireless-communications device industry and violating a recent Supreme Court ruling, rival Broadcom Corp. has alleged in a new lawsuit.

Broadcom on Tuesday opened a new chapter in its ongoing patent feud with Qualcomm, filing a new complaint in the U.S. District Court for the Southern District of California. In the suit, Broadcom asks for declaratory judgment of patent misuse and exhaustion, and patent and license unenforceability....
