Insurer Wants To Nix $2M Order In Defective Repair Suit

By Emily Field (November 11, 2015, 12:01 AM EST) -- Crum & Forster Specialty Insurance Co. on Tuesday asked South Carolina federal judge to reevaluate his decision earlier this month it owes $2 million to a builder, saying that it repeatedly had told the builder it wouldn't insure operations in the state.

U.S. District Judge Richard M. Gergal had ruled on Nov. 1 that the insurer can't enforce an exclusion for South Carolina operations in the policies because doing so would create illusory coverage for Creekstone Builders' South Carolina arm. But the insurer said that Creekstone knew before the insurer issued its 2008 policy that Crum & Forester wouldn't write coverage...
