SimpleAir Drops Mobile Message Co. From Patent Spat

Law360 (October 13, 2008, 12:00 AM EDT) -- Patent-holding company SimpleAir Holdings Inc. has dropped one defendant from its infringement suit against three media companies, including Yahoo Inc., over a patent for mobile alerts and messaging services.

Judge T. John Ward of the U.S. District Court for the Eastern District of Texas approved the dismissal of clearTXT Inc. without prejudice Friday.

Each side will pay its own costs and attorneys' fees. ClearTXT had not yet filed any response to the complaint.

Representatives for clearTXT and SimpleAir were not immediately available for comment Monday....
