Subway Owner Moves To Toss 'Frivolous' EEOC Suit

Law360, New York (October 13, 2008, 12:00 AM EDT) -- The owner of two Subway restaurant franchises has urged a federal judge to toss a religious discrimination suit brought by the U.S. employment watchdog on behalf of a worker with a nose ring, saying the case should never have been initiated.

In a motion for summary judgment filed in the U.S. District Court for the Middle District of Florida on Friday, Papin Enterprises Inc. slammed the Equal Employment Opportunity Commission for bringing a “frivolous” claim and called for sanctions against the commission.
