UK Court Denies Overcharge Damages In Cartel Suits

Law360, New York (October 15, 2008, 12:00 AM EDT) -- A U.K. appeals court has held that plaintiffs cannot receive restitutionary damages from companies sued for cartel participation, limiting the possibilities for purchasers suing BASF AG, Sanofi-Aventis and F. Hoffmann-La Roche AG for their roles in vitamin cartels in the 1990s.

The UK's Supreme Court of Judicature, Court of Appeal handed a defeat to agricultural technology company Devenish Nutrition Ltd. on Tuesday on a preliminary point of law in its appeal of a 2005 decision from the High Court of Justice.
