New Medicaid Rules Inspire Class Action Suit

Law360, New York (June 29, 2006, 12:00 AM EDT) -- A law requiring Medicaid recipients to prove U.S. citizenship has prompted a proposed class action lawsuit, which claims that new documentation requirements are unconstitutional, and that the new requirements will deny some of society’s neediest members access to Medicaid.

The new rules are at odds with constitutional guarantees of due process, according to John Bouman, an attorney with Chicago’s Shriver Center on Poverty Law, who represents the plaintiffs.
