Ford Wins PTAB Challenge Over Hybrid Vehicle Tech

Law360, Los Angeles (November 23, 2015, 7:28 PM EST) -- The Patent Trial and Appeal Board on Monday struck down numerous claims from a hybrid vehicle patent Ford has been accused of infringing, concluding that prior art renders the technology at issue obvious.

In making a final decision in an inter partes review under the America Invents Act, the board said that all seven claims of Paice LLC’s U.S. Patent Number 7,559,388 B2 challenged by Ford Motor Co. are not patentable because they are predated by four patents issued in the 1980s and 1990s, as well as by a 1994 technical paper that describe elements of the contested patent.
