Monsanto Seeks To Toss Farmer's Weed Killer Cancer Suit

Law360, New York (December 3, 2015, 3:27 PM EST) -- Monsanto Co. on Wednesday asked a California federal court to dismiss a coffee farmer's suit alleging that the company's Roundup weed killer caused her to develop cancer, saying that the suit was filed in the wrong place and is preempted by the U.S. Environmental Protection Agency's authority over herbicide labels.

Monsanto argued that the court has no jurisdiction over Christine Sheppard's claims since her allegedly cancer-causing exposure happened in Hawaii and the company is headquartered in Missouri. The farmer's claim that Monsanto failed to warn Roundup users of cancer risks is preempted by federal law, and her other product liability claims...
