7th Circ. Affirms Ruling In Ericsson Asbestos Dispute

Law360, New York (October 22, 2008, 12:00 AM EDT) -- Telecommunications company Ericsson Inc. did not violate federal environmental cleanup laws when it sold off an industrial site and left behind an inactive, asbestos-containing boiler system, an appeals court has affirmed.

The opinion, handed down Monday by the U.S. Court of Appeals for the Seventh Circuit, upholds a district court's grant of summary judgment to Ericsson in a suit brought by Sycamore Industrial Park Associates over alleged violations of the Comprehensive Environmental Response, Compensation and Liability Act, and the Resource Conservation and Recovery Act, among other...
