KPMG Tossed From Merge Tech Suit, Again

Law360, New York (October 22, 2008, 12:00 AM EDT) -- A judge has nixed a second bid by Merge Technologies Inc. shareholders to name accounting giant KPMG LLP as a co-defendant in their securities fraud class action against the medical software company.

Six months after granting the accounting giant's motion to be dropped from the suit, Judge Rudolph Randa of the U.S. District Court for the Eastern District of Wisconsin on Monday dismissed the firm again, this time from the plaintiffs' amended complaint, and this time for good.
