Takeda, Mylan Drop Claims In Diabetes Drug Suit

Law360 (October 22, 2008, 12:00 AM EDT) -- Takeda Pharmaceutical Co. Ltd. and Mylan Inc. have agreed to dismiss claims related to one of four patents at issue in a lawsuit over Mylan's plans to develop a generic version of the diabetes drug Actoplus Met.

Judge Denise L. Cote of the U.S. District Court for the Southern District of New York on Tuesday granted a joint motion by the two companies to dismiss Mylan's counterclaims of noninfringement and invalidity of U.S. Patent Number 6,166,042, issued in 2000 and titled “Pharmaceutical composition.”
