Bayer Prevails Again In Baycol MDL

Law360, New York (October 23, 2008, 12:00 AM EDT) -- A federal judge has dismissed another case from the multidistrict litigation over Bayer Corp.'s Baycol, ruling inadmissible the testimony of the plaintiffs' medical expert that linked their injuries to the cholesterol-lowering drug.

Granting the drugmaker summary judgment for the second time in just over a week, Chief Judge Michael J. Davis of the U.S. District Court for the District of Minnesota ruled the suit's nine remaining plaintiffs had failed to meet the burden of establishing that Baycol was the cause of their ailments.
