Cingular Line-Item Case Remanded To State Court

Law360 (October 28, 2008, 12:00 AM EDT) -- After a two-year battle in federal courts, a putative class action against former cell phone company Cingular Wireless LLC over a line-item bill charge will end up in the Washington state court where it began.

The decision, handed down Friday in the U.S. District Court for the Western District of Washington, remands the case to King County Superior Court after Cingular attempted to have the case thrown out on the grounds of federal preemption.
