Law360, New York (November 3, 2008, 12:00 AM EST) -- A former IBM Corp. senior executive is due to appear in federal court to explain why he should be allowed to jump ship to Apple Inc. despite his noncompetition agreement with IBM, which is concerned that he will reveal the company's trade secrets to Apple.
