Court Says Hospitals Can Be Sued Over Contractors

Law360, New York (November 3, 2008, 12:00 AM EST) -- A New Jersey appeals court has ruled that hospitals using contract doctors run the risk of being hit with malpractice claims if they fail to inform patients when they are receiving treatment from a contractor instead of a staff doctor.

The Superior Court of New Jersey Appellate Division determined last week in a suit against Christ Hospital that if a hospital does not point out that a contract doctor is providing services to a patient, the hospital ends up vesting the doctor with “apparent authority” and...
