Disputed Electricity Contracts Go Back To FERC

Law360, New York (November 4, 2008, 12:00 AM EST) -- A federal appeals court on Monday sent five electricity contract disputes from Western states back to the U.S. Federal Energy Regulatory Commission in light of a Supreme Court decision clarifying the regulator's standard for reviewing the contracts.

The disputed bilateral wholesale rate contracts were entered into at the height of the the California energy crisis earlier this decade when electricity prices may have been distorted — potentially to the tune of millions of dollars.
