ITC Rules Against Flexsys In Rubber Chemical Suit

Law360 (November 4, 2008, 12:00 AM EST) -- In a dispute involving alleged suppression of legitimate competition, the U.S. International Trade Commission has upheld the dismissal of a patent case filed by Solutia Inc. subsidiary Flexsys against rivals Korea Kumho Petrochemical Co. Ltd. and Sinorgchem Co. over antidegradant chemicals for rubber products.

The commission decided last Thursday not to review a September decision by Administrative Law Judge Paul J. Luckern granting KKPC and Sinorgchem summary judgment on the grounds that an earlier agreement precluded Flexsys from bringing the suit.
