High Court Takes On First Anti-Dumping Case

Law360, New York (November 4, 2008, 12:00 AM EST) -- The U.S. Supreme Court dove headlong into its first-ever anti-dumping case Tuesday, the justices sparring with attorneys over the question of whether sending uranium overseas for enrichment constitutes a sale of merchandise or services.

French company Eurodif SA and the U.S. Department of Commerce have long been locked in a legal battle over the import of low-enriched uranium, which is used in commercial nuclear power plants. Eurodif receives unenriched uranium from U.S. utilities and sends back low-enriched uranium.
