Benefit Payments Don't End When CBA Does: 2nd Circ.

Law360 (November 5, 2008, 12:00 AM EST) -- The expiration of a collective bargaining agreement doesn't let meat-processing company Cibao Meat Products Inc. off the hook for paying into employee benefit funds, a federal appeals court has ruled.

The U.S. Court of Appeals for the Second Circuit on Tuesday enforced a National Labor Relations Board order that Cibao had violated fair labor practices when it stopped paying into benefit funds after its agreement with the workers union expired.

Bronx, N.Y.-based Cibao contended that “economic exigency” exempted the company from paying into the funds. And...
