Philips Prevails In Appeal Over 'Faulty' TVs

Law360, New York (November 6, 2008, 12:00 AM EST) -- An appeals court has dashed the hopes of a consumer who sought to revive a putative class action against Philips Electronics North America Corp. over allegedly defective televisions.

In a summary order issued Wednesday, the U.S. Court of Appeals for the Second Circuit upheld a ruling by the U.S. District Court for the Eastern District of New York denying the plaintiff's class certification bid and dismissing the action for lack of subject matter jurisdiction.
