Mo. Right Venue For Teva Amoxicillin Suit: Judge

Law360, New York (November 11, 2008, 12:00 AM EST) -- A suit against generic-drug maker Teva Pharmaceuticals over an alleged side effect of amoxicillin will be heard in Missouri state court despite an earlier removal for diversity of citizenship, a federal judge has ruled.

Judge Carol E. Jackson issued an order Friday in the U.S. District Court for the Eastern District of Missouri saying the removal of the case was “improper” and that the suit would be remanded to the Twenty-Second Judicial Circuit Court of Missouri.
