CR Bard Falls Short In Bid To Nullify Class

Law360 (November 11, 2008, 12:00 AM EST) -- The U.S. Court of Appeals for the Eighth Circuit has rejected C.R. Bard's petition to overturn class certification in an antitrust case over urological catheters for hospitals.

On Wednesday, the Eighth Circuit sided with St. Francis Medical Center and other class members in the dispute over an allegedly anti-competitive scheme hatched by C.R. Bard that purportedly drove up prices of urological catheters for hospitals.

A trial has been scheduled for April 2009 in Cape Girardeau, Mo., according to Kirby McInerney, the plaintiffs' attorneys.
