Roche, Mutual Drop Part Of Suit Over Boniva

Law360 (November 13, 2008, 12:00 AM EST) -- Hoffmann-La Roche Inc. and Mutual Pharmaceutical Co. Inc. have dropped all claims and counterclaims related to one patent at the center of a fight over the osteoporosis drug Boniva.

In an order filed Thursday, Judge Stanley Chesler of the U.S. District Court for the District of New Jersey agreed to the stipulation filed by Roche and Mutual Pharmaceutical to dismiss the claims related to U.S. Patent No. 6,294,196.

The move still leaves U.S. Patent No. 7,192,938, which is set to expire in May 2023, in play...
