5th Circ. Rebuffs Insurers In Vioxx Settlement

Law360, New York (November 18, 2008, 12:00 AM EST) -- An appeals court has affirmed the denial of preliminary injunctions in a lawsuit brought by numerous insurance companies against the administrators of the $4.85 billion Vioxx settlement.

A three-judge panel of the U.S. Court of Appeals for the Fifth Circuit said Monday that the lower court was right to deny the injunctions sought against the settlement's claim administrator, BrownGreer PLC, and the escrow agent, US Bancorp Inc.
