Tribal Tobacco Co. Immune From Suit: 10th Circ.

Law360, New York (November 19, 2008, 12:00 AM EST) -- A tobacco distributor can't sue Seneca-Cayuga Tribal Tobacco Corp. for allegedly breaking antitrust laws because the tobacco company is part of a sovereign nation immune from federal suits, an appellate court has ruled.

On Monday, the U.S. Court of Appeals for the Tenth Circuit affirmed a lower court's ruling dismissing the case brought by Native American Distributing alleging Seneca-Cayuga had engaged in anti-competitive behavior.
