Illegal Aliens Can Sue Employers: NY Appeals Court

Law360, New York (November 19, 2008, 12:00 AM EST) -- A New York state appellate court has ruled that undocumented workers aren't necessarily barred from suing employers for damages, even if the employees used fraudulent documents to get hired.

The Supreme Court of the State of New York, Appellate Division, rejected on Nov. 12 an employer's claim that it wasn't liable for damages related to a workplace accident because the injured worker lacked legal status.
