Travelers' Asbestos Exclusion Is Unenforceable, 3rd Circ. Told
By Jeff Sistrunk (March 22, 2016, 8:34 PM EDT) -- General Refractories Co. urged the Third Circuit on Tuesday to uphold a Pennsylvania district court's judgment awarding it more than $36 million in a suit accusing Travelers of improperly denying coverage for asbestos exposure claims, arguing that the lower court correctly ruled the asbestos exclusion in its policy is unenforceable.
In a response brief filed with the appellate court, GRC asserted that U.S. District Judge L. Felipe Restrepo was right to find that the asbestos exclusion in policies issued to the company by a Travelers Casualty & Surety Co. predecessor is ambiguous and therefore does not preclude coverage for claims made...
