Antitrust Counterclaims To Stay In Lens Patent Feud

Law360 (November 19, 2008, 12:00 AM EST) -- A federal judge has denied Carl Zeiss Vision Inc.'s bid to throw out four antitrust and unfair competition counterclaims filed by rival optical lens company Signet Armorlite Inc. in an ongoing infringement lawsuit over a patent covering spherical spectacle lenses.

In an order handed down Wednesday, Judge Dana M. Sabraw of the U.S. District Court for the Southern District of California rejected Zeiss' argument that Signet’s federal unfair competition claim should be tossed because the conduct underlying those claims wasn't “objectively baseless.”
