Summary Judgment Bids Nixed In NJ CERCLA Suit

Law360 (November 21, 2008, 12:00 AM EST) -- In an opinion that clarifies aspects of the Supreme Court's U.S. v. Atlantic Research Corp. ruling on Superfund liability, a federal judge has denied cross motions for summary judgment from Reichhold Inc. and United States Metals Refining Co., determining that issues of material fact pertaining to the contamination remain in dispute.
