Ex-Mervyn's Workers Bring WARN Class Action

Law360, New York (November 21, 2008, 12:00 AM EST) -- A group of laid-off Mervyn's LLC employees have brought a putative class action against the bankrupt department store chain, alleging the company terminated hundreds of workers last month without fair warning.

Three Hayward, Calif.-based former workers filed their adversary complaint in the U.S. Bankruptcy Court for the District of Delaware on Thursday seeking 60 days' unpaid wages and pension benefits for what they allege are breaches of the Worker Adjustment and Retraining Notification Act.
