Pfizer Wins Choice-Of-Law Appeal In Lipitor Actions

Law360 (November 21, 2008, 12:00 AM EST) -- Ruling that the place of injury was the locus of a tort in a product liability case, New York's appellate court has dismissed three cases by Michigan residents against Pfizer Inc. over its popular cholesterol drug Lipitor.

The appellate division of the state's Supreme Court on Thursday unanimously upheld a decision by Justice Martin Schulman in March last year to toss the cases, after ruling the operative law a Michigan statute that shields Pfizer from liability in cases involving drugs approved by the federal regulator....
