GSK Parent Off The Hook In Paxil Birth Defect Suit

Law360, New York (November 24, 2008, 12:00 AM EST) -- Parents of a child who allegedly suffered heart problems from his mother’s use of the drug Paxil cannot add parent company GlaxoSmithKline PLC to a product liability suit against SmithKline Beecham Corp., a federal judge has ruled.

Judge Claire V. Eagan issued a decision Thursday in the U.S. District Court for the Northern District of Oklahoma denying Bartlesville, Okla., residents Jennifer and Justin Hayes the opportunity to amend their complaint, stating that the plaintiffs have no valid claim against the corporate parent.
