US Liable For Air Marshals' Overtime Pay: Court

Law360, New York (November 24, 2008, 12:00 AM EST) -- Federal air marshals are entitled to collect overtime pay under the Fair Labor Standards Act, although those overtime wages are offset by “availability pay” already received, a federal claims court has determined.

Judge Bohdan A. Futey of the U.S. Court of Federal Claims handed down the ruling Thursday, denying the government's motion for summary judgment, granting the air marshals' partial motion for summary judgment and ordering the government to pay its air marshals time-and-a-half compensation for hours worked in excess of 50 hours per week....
