Appeals Court Remands Playboy's Trademark Suit Vs. Netscape

Law360, New York (January 14, 2004, 12:00 AM EST) -- In a case with wide implications for online advertising, a three-judge panel of the 9th U.S. Circuit Court of Appeals on Wednesday reinstated a trademark infringement lawsuit by Playboy Enterprises Inc. against Netscape Communications Inc.

The appeals court ruled that search engines are barred from displaying advertising related to trademarked search terms. It said a lower case had erred in deciding against the adult entertainment company.
