Roche, Apotex Drop One Patent In Spat Over Boniva

Law360 (November 25, 2008, 12:00 AM EST) -- Hoffmann-La Roche Inc. and Apotex Inc. have dropped all claims and counterclaims related to one patent at the center of a fight over the osteoporosis drug Boniva.

U.S. District Judge Stanley R. Chesler of the U.S. District Court for the District of New Jersey on Monday signed an order dismissing with prejudice all claims related to U.S. Patent No. 6,294,196.

The companies agreed to drop those charges because Roche granted Apotex a covenant not to sue for the '196 patent after reviewing Apotex's current proposed generic...
