Delphi Creditors Aim To Use SEC Data In GM Lawsuit

Law360, New York (July 27, 2006, 12:00 AM EDT) -- The creditors of a bankrupt auto parts maker said Thursday that they plan to use confidential information from a U.S. Securities and Exchange Commission probe to prepare for a lawsuit against General Motors Corp.

An attorney for Delphi Corp.’s creditors asked the court to allow a draft of the lawsuit to be sealed, saying that if the information was made public it could hinder Delphi's restructuring negotiations.

The request to seal the documents was approved by Judge Robert E. Gerber on Thursday.
