Vaginal Deformity Claims To Proceed Against AMS

Law360, New York (November 26, 2008, 12:00 AM EST) -- American Medical Systems Inc. must face a woman's claims that she developed severe vaginal deformities and other serious medical problems after undergoing reconstructive surgery to implant the medical device manufacturer's Apogee mesh system, a federal judge has ruled.

The Nov. 26 ruling by Magistrate Judge James Larson of the U.S. District Court for the Northern District of California came despite assertions by AMS' counsel, Samantha Hilton of Kenney & Markowitz LLP, that plaintiffs Terry and Ellen Ambroff hadn't met federal pleadings requirements in making their state-law...
