Law360, New York ( April 14, 2016, 5:30 PM EDT) -- This week, social media was abuzz with news that popular fast food chain In-N-Out Burger's lawyers sent a cease-and-desist letter to bikini-clad model Abigail Ratchford and her producer, LiveRichMedia, demanding that they take down a short video clip featuring Ratchford eating and frolicking with her In-N-Out fries and drinking (and spilling on herself) an In-N-Out milkshake. In-N-Out would have no chance of prevailing in a lawsuit against Ratchford or the producer. There is simply no legal theory on which In-N-Out can hold Ratchford or LiveRichMedia liable for enjoying In-N-Out products in a video....
