Sherwin-Williams Denied Legal Fees In Cleanup Suit

Law360, New York (December 1, 2008, 12:00 AM EST) -- A federal judge has shot down Sherwin-Williams Co.'s bid for attorneys' fees in an environmental cleanup dispute with the city of Emeryville, Calif., despite an earlier ruling protecting the company from direct liability for the site at issue.

Sherwin-Williams had asked Judge William Alsup to alter a recent judgment to allow the company to recover attorneys' fees on its breach of contract claim after the judge found that a 2001 settlement agreement prevented the city from asserting cleanup damages against the company.
