Del. High Court Maintains $47.2M Dr Pepper Payout

Law360 (December 2, 2008, 12:00 AM EST) -- The Supreme Court of the State of Delaware has overturned a ruling reducing the amount the court said Dr Pepper-Seven Up Bottling Group Inc. owes investors in litigation over its 1999 merger with Dr Pepper Bottling Holdings Inc.

A lower court had attempted to correct errors it made in calculating Holdings' value at the time of the merger, but the high court ruled Monday that the modification was moot because a $47.2 million settlement in the case had already superseded the appraisal.
