Timbervest Urges DC Circ. To Ax SEC In-House Verdict

Law360, New York (April 22, 2016, 11:44 PM EDT) -- The D.C. Circuit on Friday was presented with another chance to decide the constitutionality of the U.S. Securities and Exchange Commission’s in-house court when Atlanta-based investment adviser Timbervest LLC filed its opening statement on an appeal of an agency sanction against it and four of its principals.

The 83-page brief asks the D.C. Circuit to overturn the sanctions the commission imposed in September against Timbervest and its four owners after the agency found they had violated disclosure rules during an allegedly problematic land deal.
