11th Circ. Reverses Class Denial In X-Ray Overbilling Suit

By Cara Salvatore (April 27, 2016, 4:47 PM EDT) -- The Eleventh Circuit on Tuesday revived a potential class action alleging 80 Florida hospitals overcharged by breathtaking amounts for post-car-crash X-rays and CT scans, saying a judge skipped crucial discovery when he decided that the issues were too individualized for class litigation.

An appeals court panel reversed the dismissal of class allegations in a suit by personal injury protection, or PIP, insurance customers against hospital owner HCA Holdings Inc. In Florida, all car owners have to carry $10,000 worth of PIP insurance.
